1. Who We Are & Acceptance of Terms
The Operational Mirror (“TOM,” “we,” “us,” or “our”) is a service operated by Dexability Co, a company based in Washington State, USA. These Terms of Service (“Terms”) govern your purchase and use of TOM.
By purchasing TOM, submitting information through our intake forms, or accessing your interactive report, you agree to be bound by these Terms. If you do not agree, do not purchase or use TOM.
TOM is a separate, standalone service. It is not part of, and has no contractual relationship with, The Relocation Navigator or any other Dexability Co offering. Each service is governed by its own terms.
2. What TOM Is (and Isn’t)
TOM is a one-time operations and compliance analysis for e-commerce founders. Based on information you provide, we produce a single interactive report that examines your business operations, people and contractors, tools and automation, and compliance and risk exposure.
TOM is a self-serve, no-call, no-consultant service. We do not provide ongoing advisory services, implementation work, or consulting engagements as part of TOM. We deliver a report; what you do with it is up to you.
3. Eligibility
TOM is intended for business owners and founders who are at least 18 years old and have legal authority to submit information about the business in question. You confirm that any business, financial, or personnel information you submit is information you are authorized to share with us.
4. The TOM Process & Timeline
TOM operates on a fixed, time-bound process. The relevant windows are not negotiable on a case-by-case basis, because the bonus and refund eligibility described in Section 6 depend on everyone being held to the same clock.
4.1 Step One — Purchase & 72-Hour Window
After your one-time payment, you have 72 hours from the time of purchase to submit both required parts of your intake (Part 1 and Part 2, described below) in order to remain eligible for a refund and for the complimentary in-depth social media analysis bonus. See Section 6 for full details.
If you have not returned both Part 1 and Part 2 by the end of the 72-hour window, we will reach out one time to request the missing information. If we receive no response, or the missing information is still not submitted within 72 hours of that notice, we will proceed with your analysis using whatever information is available. An analysis based on partial information will not be in-depth, since missing half the required information materially limits what can be assessed. TOM does not chase clients for missing information beyond this single notice — submitting your complete intake within the original 72-hour window remains your responsibility.
4.2 Step Two — Processing Begins
Once your intake is resolved — either because you submitted complete information within the original 72-hour window, or because the follow-up grace period described above has closed — your analysis enters processing on the next business day. We will notify you when processing begins. If you submitted complete intake on time and, for any reason, that notification does not reach you or go unseen, processing is treated as having started no later than Day 4 after your purchase. Business days are Monday through Friday, excluding weekends.
4.3 Step Three — Report Delivery
Your completed interactive report is delivered within 5 business days of when processing begins. If you qualified for the bonus in-depth social media analysis (Section 6), it is delivered together with your report at the same time.
5. Pricing & Payment
TOM is offered as a single one-time payment of $1,496 USD. Payment is processed securely through Stripe at the time of purchase. We do not store your full payment card details.
Prices are subject to change for future purchasers, but the price you pay at checkout is locked in for your purchase and will not change retroactively.
6. Refunds & the Bonus Social Media Analysis
Full details of our refund terms are set out in our separate Refund Policy, which is incorporated into these Terms by reference. In summary:
- You may request a refund only within 72 hours of purchase, and only if you have also submitted both Part 1 and Part 2 within that same window.
- Missing the 72-hour window — whether by not submitting your information, not requesting a refund, or both — forfeits your refund eligibility and your eligibility for the complimentary in-depth social media analysis bonus.
- After the 72-hour window closes, your purchase is non-refundable, for any reason.
- We will still request and accept your remaining intake information after the window closes so we can complete your analysis, but doing so does not restore refund or bonus eligibility.
See our Refund Policy for the complete terms.
7. Your Responsibilities
You are responsible for the accuracy and completeness of the information you submit. TOM's analysis is only as good as the information it's built on — incomplete, outdated, or inaccurate submissions will produce an incomplete or inaccurate report, and we are not responsible for conclusions drawn from information you provided incorrectly or omitted.
You agree to monitor the email address used at checkout for intake requests and delivery notifications, and to respond within the timeframes described in Section 4.
8. Report Access & Delivery Platform
Your interactive report is currently hosted and delivered via Libertify. Dexability Co intends to migrate report delivery to a custom-built platform in the future; if and when that occurs, we will take reasonable steps to ensure your existing report remains accessible, and will notify affected clients of any change in delivery platform.
Your report remains accessible on the delivery platform indefinitely following delivery, subject to the data handling terms in our Privacy Policy.
9. Not Legal, Tax, or Financial Advice
TOM's report is an operational and compliance-oriented analysis based on the information you provide. It is not legal, tax, financial, or accounting advice, and should not be relied on as a substitute for advice from a licensed attorney, accountant, or other qualified professional. Compliance and risk observations in your report are informational and based solely on the information you submitted — they are not a legal compliance audit or a guarantee that your business meets any specific legal or regulatory standard.
10. Use of AI in Producing Your Analysis
Producing your TOM report involves the use of AI-assisted tools, including third-party large language model technology, to process and analyze the information you submit. Output generated with the assistance of these tools is reviewed and packaged as part of your final report. By using TOM, you acknowledge and consent to this processing. See our Privacy Policy for details on which third-party tools are involved and how your data is handled.
11. Intellectual Property
The TOM methodology, report structure, scoring frameworks, and underlying systems are the property of Dexability Co. Your completed report is provided to you for your own internal business use. You may not resell, redistribute, or represent the TOM methodology or report templates as your own work product.
The business data, answers, and information you submit remain yours. We use it solely to produce your report and as otherwise described in our Privacy Policy.
12. Confidentiality & Data
How we collect, use, share, retain, and delete the information you submit is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it before purchasing.
13. Limitation of Liability
TOM is provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, Dexability Co disclaims all warranties, express or implied, regarding TOM, including any warranty of fitness for a particular purpose or that the report will identify every operational, compliance, or risk issue present in your business.
To the fullest extent permitted by law, Dexability Co's total liability arising out of or relating to TOM shall not exceed the amount you paid for TOM. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption, arising from your use of or reliance on your report.
14. Termination
We may decline to provide TOM, or may discontinue an in-progress analysis, if you submit fraudulent, abusive, or materially false information, or if continuing would violate applicable law. In such cases, refund eligibility is governed by Section 6 and our Refund Policy.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to TOM or these Terms shall be brought exclusively in the state or federal courts located in Washington State, and you consent to the jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from
